Proposed Cap on Care Costs is not what it's cracked up to be

Government plans to implement a cap on care costs as part of the 2014 Care Act should be read with a close eye on the small print according to our probate expert Katie Swift.

Whilst the anticipated cap of £72,000 on what an individual would pay sounds encouraging, this will not include the lion's share of care home costs, such as those made for food and accommodation. Additionally, the cap will not be backdated for anyone who has been in care prior to the date the Act is implemented (Part 1, the care assessment process in April 2015 and Part 2, the charging provisions in April 2016). In reality, the total costs incurred by someone in care by the time they reach the proposed £72,000 cap is likely to far exceed this amount.
